Ben Gurion train station to close for anyone arriving in Israel.

“Against the backdrop of efforts to prevent the spread of the Coronavirus, it was decided that by Wednesday the train station at Ben Gurion Airport will be closed to anyone arriving in Israel. Domestic flight passengers will be able to use the train services upon presentation of a plane ticket. Passengers on domestic flights landing at Terminal 1 will be able to use the train as usual.

This decision was made following the directive issued last night, which states that anyone returning to Israel outside its borders will enter home isolation for two weeks.” Hebrew article here…

New public transport directives

Following the Coronavirus outbreak, Israel’s Transportation Ministry announced new directives for public transport throughout the country, including a ban on standing passengers on intercity trips.  Passengers are also forbidden from sitting in the front row of seats.  Windows are to be kept open as much as possible.

Hebrew is an ancient language and as such, lots of foreign words have entered into the Hebrew lexicon and Latin words too. One of those words is the Latin word for ‘liquid poison’ – virus. “Yeish li virus” (יש לי וירוס) is the street-Hebrew translation for “I have a virus”.

Israel air travel restrictions

Israel’s worldwide air travel restrictions because of coronavirus.

As of 8pm 09.03.2020 all travelers arriving in Israel, from anywhere in the world, are required to self-quarantine for a period of 14 days.  This is further to the recent Israel MOH guidelines and travel restrictions which were aimed at containing the spread of the novel Covid-19 coronavirus. Until now only travelers from China, Hong Kong, Thailand, Japan, Singapore, South Korea, Taiwan and Macau, France, Germany, Switzerland, Austria, Andorra, San Marino, Spain and selected Middle East countries had to enter a 14 day period of quarantine.

ISRAEL AIR TRAVEL RESTRICTIONS

Travel restrictions are now in place for all of Israel’s residents and and tourists.  Israel residents are required to self-quarantine for 14 days.  If tourists entering Israel can prove that they can self-quarantine for the required period, they will be allowed to enter Israel, if not, they will be denied entry. This decision will be reviewed in 2 weeks.

The Israel Ministry of Health is asking that tourists follow these five guidelines:

  1. Call Magen David Adom if they experience any symptoms
  2. Pay careful attention to personal hygiene
  3. Stay away from public gatherings
  4. Understand that they cannot exit and then re-enter the country and
  5. Report on their whereabouts while in Israel

Kidnapped Children and Hague Cases

“Of Kidnapped Children and Hague Cases”

I would like to address a very serious problem we have here in Israel.

Unfortunately, and especially in light of the fact that Israel is a country of immigrants, there is a relatively high number of “parental kidnappings” (usually, the non-return of children from Israel to the home country) on a pro-rata basis as compared to most other Western countries.

Fortunately, Israel is a member of the Hague Convention of 25 October 1980 on the Civil Aspects of International Child Abduction (the “Hague Convention”).  Via the Hague Convention and its enactment in Israel, there is a formal, quick, and efficient procedure to arrange for the return of children to their home countries.

These cases are generally cases of a very sensitive nature.

Below are some questions and answers that I usually get and give when unfortunate parents find themselves in this situation.

1.   In which sort of situations can the Hague Convention be utilized?

When children under the age of 16 are abducted from their habitual residence, the remaining (or “left behind”) parent is able to utilize the Hague Convention to bring about the swift return of their children.  Abducted children for purposes of the Hague Convention means wrongfully removed to or retained from their habitual residence (home country).

2.   What are the timelines in the Hague Convention?

As per the Hague Convention, the suit must be filed within a year.  As a practical matter, the longer people wait to file their suits, the more of a chance that the children will not be returned.  The percentage of children returned from Israel when the remaining parent files suit after six months is much lower than the percentage of children returned when filing has been swiftly.  We recommend that people file within three months from the date of the “kidnapping” (whether wrongful removal or wrongful retention of the child(ren)).

Once a Hague Convention lawsuit has been filed in Israel, which is done in the Family Court that has jurisdiction where the child is living in Israel, the court is supposed to have an urgent first hearing which is to be set no more than fifteen days from the date of the filing of the suit.

The parent who has abducted the children is allowed to respond up to two days in advance of the initial urgent hearing date.

At the initial urgent hearing, a timeline for the full (evidentiary) hearing of the Hague Convention application lawsuit is set.

At the full (evidentiary) hearing, the court may allow or refuse to hear witnesses; the court may hear the child depending on age or maturity; and the court may request psychological reports to be done on either or both parents and the child(ren).

The court is supposed to issue its final decision within six weeks from the initial filing of the suit.

Appeals to Hague Convention final decisions may be made within seven days (to the Israeli District Court) and it is to be heard within ten days of filing of the appeal.  The parties’ legal arguments for the appeals are to be filed up to two days before the appeal hearing.

The ruling in appeals is to be given within thirty days from the date of filing.

In practice, including typical delays, etc. you should expect the whole process to take between forty five and ninety days from the date you initially file.



3.   In which situations will children not be returned?

Hague Convention case outcomes are highly dependent upon the factual situations involved in each case – they are what we call “fact-intensive.”  That is why it is very important to work hand in hand with your attorneys to ensure that they have all of the evidence to present your “story” to the court.

Pursuant to Article 13 of the Hague Convention, children will not be returned in the following situations:

a.   When the remaining parent was not actually exercising his or her custody rights at the time of the abduction

b.   When the remaining parent either agreed to, consented. or acquiesced to the child(ren)’s living in (i.e. changing the habitual residence to) Israel.

c.    When the child(ren) objects to being returned to the home country – and the court determines that they are old enough and mature enough that their wishes should be taken into account.

d.   When there is a grave risk that the child will be harmed if they are returned.

e.   When the home country of the child does not follow certain fundamental principles of human rights and freedoms.

4.   Will a Hague case determine if I have custody over my children or if I will be divorced?

Although the results of a Hague Convention case may influence future custodial issues if subsequent litigation is pursued, the final ruling of the Hague Convention case is not connected to custody.  It is also not connected to divorce.  The main issue decided in the final rulings Hague Convention cases is essentially which legal jurisdiction (the home country or Israel) is the proper legal jurisdiction over the child(ren) to decide issues regarding the child(ren).  After the final ruling of the Hague Convention case, other issues can be addressed (such as divorce, custody, child support, etc.), if the parties elect to do so, in the country that has the jurisdiction over those issues.

For this reason, a Hague Convention case will not generally utilize the test used by most courts in determining other child –related litigated matters (i.e. “what is in the ‘best interest’ of the child”).

5.      What type of evidence will I need if we have for a Hague Convention trial?

The good thing about Hague Convention cases is that, relative to other family law cases, they are very quick.  The bad thing is that this means that you have one “bite at the apple” and you have to do it right from the get go.  You have to help your attorneys by quickly getting them lots of evidence – you have to support your position and you can expect that your spouse or ex-spouse will lie, cheat, and distort facts in an effort to win the case.

In some instances, if you have enough evidence you may be able to get the other side to capitulate just by their reviewing (or their attorney’s reviewing) of the strength of your case.

Many times Hague Convention cases turn into “he said/she said” arguments between the parties.  This is the reason that you are best served if you are able to supply a lot of documentary evidence that can be supplied to the court.  You should get hold of copies of any and all documents – visa applications, school and medical documentation, travel documentation, emails, text messages, voice mails, household bills, banking and employment records, etc. Anything that can show that there was never any mutual intent that your children remain permanently in Israel.

Like I said – these are highly intensive types of cases and I hope that nobody reading this ever has to go through this type of situation.  That being said – forewarned is forearmed.

We were asked to prepare an outline of the two main players in Monday’s election; Likud and Blue & White. We’ve put this article together and are sharing it with you in the  hope that it will help you make your important decision.

Brief history of the Likud party

  • Founded in 1973.
  • In the political map, Likud identifies itself as right-wing.
  • The Likud began as a joint list comprised of Herut, the Liberal party, the Free Center, the State List, and the Labor Movement for a Greater Israel.
  • In 1988, these parties merged to form one party, which was also called the Likud.
  • The first time the Likud came to power was in 1977 and headed by Menachem Begin.  It remained in power until 1984.
  • In 1996, the Likud returned to head the government under the leadership of Bibi Netanyahu – his first term of office.
  • In 2009 the Likud won the elections again with Netanyahu as party leader.  This marked the start of the second Netanyahu government.
  • In total Bibi Netanyahu has headed the Likud party (as Prime Minister) for 14 years.
  • Prominent leaders of the Likud over the years: Menachem Begin, Yitzchak Shamir, Benjamin Netanyahu, Ariel Sharon, David Levy, Moshe Arens, Yitzhak Moda’i, Moshe Nissim, Dan Meridor, Ehud Olmert, Moshe Katzav and Silvan Shalom

The Likud’s basic platform…

Unlike Blue & White, no official party platform was available on the Likud website.

The Israel Democracy Institute outlines the Likud’s platform as follows:-Likud has traditionally supported the idea of the whole Land of Israel, even if it has not always defined the state’s borders precisely. Although it refused to recognize Palestinian demands for sovereignty for a long period of time, the Likud has since moderated its stand. The Likud  agreed to concessions in the Camp David Accords in 1979, began negotiations with the Palestinians during the Madrid Conference in 1991, continued the implementation of the Oslo accords, and unilaterally disengaged from the Gaza Strip in 2005, when it evacuated the Jewish settlements in that area.

On socio-economic issues, the Likud has right-wing, conservative views and advocates a free market. Despite this, however, the Likud enjoys the support of economically disadvantaged populations. The Likud has taken steps to privatize the economy, while at the same time setting a minimum wage, passing the State Pension Law, etc. On issues of religion and state, the Likud has centrist views. Although it is a secular party, the religious parties consider it to be a more comfortable coalition partner than the Alignment or the Labor Party.

  • Blue and White identifies itself as a Zionist Liberal party located in the center of the political map

Protecting Gifts in Divorce.

How to give gifts to your children in a way to protect them in case of future divorce.

As we go towards a third election on March 2nd, 2020, and considering that we may be stuck yet again with no conclusive outcome, I wanted to share with you some ways in which you can ensure that at least some things do get a conclusive outcome.  What am I talking about?  Children, gifts, and divorce.

Now, most of us give gifts of some sort to our children – some financial and some not financial.  Today I am going to address some of the financial gifts – whether it be giving them cash out-right or helping them to make major purchases – i.e. like buying an apartment.

Now I know that none of us want to think about our children getting divorced (and quite frankly, I have told people many times that if their children are having marital issues that it would probably be a much better investment to pay for marital counselling for their children rather than to pay legal fees to me for divorce later on), but the fact is that one out of three marriages in Israel ends in divorce.

So… what happens to gifts that you gave to your one of your children and the time comes that they are
getting a divorce?  First, we should look on what the general rule regarding the division of assets in case of divorce.  That rule dictates that, absent a pre-nuptial or other legally binding agreement, assets that were accumulated during the course of a marriage (as well as debts) are to be split equally.  What that means is that, if for example you gave one of your children 500,000 NIS to purchase an apartment together with his or her spouse, that when they get divorced your son or daughter will not get a credit for that 500,000 NIS, but rather each of the spouses will get the benefit of that gift.  You may feel that this is your intent when you made the gift – but would that feeling change if divorce came only one or two years after the gift was made?  If so you may wish to “undo” the gift – but you can’t.

The problem is that once the gift is made it is legally complex (and usually impossible) to undo. Therefore, you have to take the proper steps when making the gift to ensure that in case of divorce that your child gets the monetary credit for the gift that you made.

There are a number of ways that this can be achieved.

The first way is for your child and his or her spouse to enter into a monetary agreement.  In this scenario, your son and his or her spouse would enter into a monetary agreement, that has to be affirmed by a judge in order to be valid, that would state the terms upon which the gift (and/or the increase in equity of the asset purchased with the gift…) gets returned to your child upon divorce.  The problem with this method is that monetary agreements can always be amended – so that if your child in the future wants to change the agreement (i.e. prior to divorce) he or she can, and they my give up the rights that you intended for them to have via the monetary agreement.

Another way is for you as the person giving the gift to be the owner of part of what the gift is being used for.  In other words, let’s say that your son and his wife are purchasing an apartment for 1,500,000 NIS and you are giving the same 500,000 NIS gift.  You may want to be registered as the owner of one third of the apartment and then in case of divorce you would get one third of the proceeds.

Another way is to structure the gift as a loan.  If you do this, then you have to have both your child and his or her spouse sign on a formal loan agreement, and register a notification against the deed in the land registry regarding the loan and its terms.

All of these are different manners by which you can protect gifts made to your children.  While none of them are one hundred percent iron clad and non-challengeable in every case, by getting proper legal advice and having the proper documentation drawn up, you will vastly increase the chances that in case of divorce your hard-earned money goes to the hands of the person that you intended.

Again – by taking the proper actions in advance you may be able to help your children avoid getting into loops of non-conclusive outcomes like we seem to be doing in our political system.
